Terms of Service

Out Market Them (“we,” “us,” “our”) is a web design and digital marketing service operated by Out Market Them LLC, a company registered in the State of Wyoming, United States, serving US small businesses. By engaging our services or subscribing to a plan, you agree to these terms.

Out Market Them offers the following tiers. All tiers include a custom-built website at no upfront cost. The build is always free.

• Free ($0): We build your site, you approve it, and we deliver a complete zip file. You host it anywhere. No ongoing subscription required. A “Built by OMT” credit link in the footer is required.
• Hosting ($49 USD/month): Netlify hosting, domain pointing, SSL, security, uptime monitoring, daily backups, form-to-email routing, and email support.
• The SEO ($249 USD/month): All Hosting inclusions, plus 4 SEO blog posts per month, ongoing SEO optimization, Google Business Profile management, local SEO and citation building, and monthly performance reporting.
• Growth ($999 USD/month): All The SEO inclusions, plus Google Ads management, Meta Ads management (no markup on ad spend), custom ad creative direction, conversion tracking and attribution, weekly strategy review, and a dedicated strategist.

Customers may upgrade or downgrade tiers at any time. Tier changes take effect on the next billing cycle. No fees to switch.

You may cancel your subscription at any time. There are no minimum terms, no contracts, and no early cancellation fees.

Upon cancellation, Out Market Them will provide a complete export of your website as a downloadable zip file. You may host the site with any provider thereafter.

You own your website from the moment we build it. Out Market Them hosts and manages the site during the subscription period under license from you.

On cancellation, we deliver a complete zip of all site code, content, and assets. Out Market Them does not retain ownership of your domain, content, or website at any point.

All sites built by Out Market Them include a “Built by OMT” credit link in the footer. This link is a condition of the free build and remains on all tiers.

Subscription fees are charged monthly. Failure to pay within the grace period may result in service suspension. The free tier has no payment obligation.

Included services are defined by the active tier (see Section 2). Additional services are subject to separate agreements and pricing.

You agree not to use our services for illegal activity, spam, harassment, or any purpose that violates applicable law. We reserve the right to suspend service for violations without refund.

Out Market Them and Out Market Them LLC are not liable for indirect, incidental, or consequential damages arising from use of our services. Our total liability in any dispute is limited to fees paid in the prior 30 days.

These terms are governed by the laws of the State of Wyoming, United States, to the extent applicable to US customers. Disputes will be resolved in accordance with applicable law.

Out Market Them reserves the right to modify these terms with 30 days’ notice. Existing customers retain the terms in effect at the time their subscription began.
